Terms of Use (EULA)

The agreement that governs your use of Momently on iOS.

These Terms of Use (“Terms”) are a binding End User License Agreement (EULA) between you and Momently (“we”, “our”, or “us”) for the Momently iOS application and related features (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Momently on Apple devices you own or control, solely for your personal, non-commercial use, and subject to these Terms and the Apple Media Services Terms and Conditions / App Store rules that apply to you.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the App except to the extent such restrictions are prohibited by applicable law.

What Momently is

Momently helps you create life moments (such as anniversaries, trips, and birthdays), design photo-based Home Screen and Lock Screen widgets, optionally use Live Activities near an event, and share moments with others using Apple system tools (for example AirDrop or the share sheet).

Momently is local-first: it does not require a Momently account, and it is not a cloud backup or messaging service.

Your content

You retain ownership of content you create or choose in the App, including titles, notes, dates, photos, and design choices (“Your Content”). You are responsible for Your Content and for having the rights needed to use and share it.

When you export or share a moment, you choose the destination. Recipients receive a local copy under their own control. We do not operate a Momently cloud account that hosts Your Content for others.

Acceptable use

You agree not to:

Use the App in any way that violates applicable law or third-party rights
Upload or share unlawful, infringing, or harmful content
Interfere with the App’s operation, security, or other users’ devices
Misrepresent affiliation with Momently or attempt to circumvent Pro entitlements

Momently Pro, subscriptions, and purchases

Some features (for example advanced widget designs, custom photo backgrounds, and Live Activities) may require Momently Pro. Purchases—including auto-renewable subscriptions and lifetime unlocks—are processed by Apple through the App Store / StoreKit. Payment, billing, refunds, and subscription management are handled by Apple under Apple’s terms.

Auto-renewable subscriptions renew unless canceled at least 24 hours before the end of the current period in your Apple ID subscription settings. Prices displayed in the App are provided by Apple and may vary by storefront and currency.

Pro access may be verified using Apple transaction data and related entitlement checks so features can unlock on your device. Purchases are tied to your Apple ID and may not transfer between unrelated Apple IDs.

Widgets, Live Activities, and system features

Home Screen widgets, Lock Screen widgets, and Live Activities depend on Apple platforms and system permissions. Availability, refresh behavior, and presentation are controlled by iOS and may vary by device, settings, and system limits (including Live Activity duration limits).

Privacy

How information is handled is described in our Privacy Policy, which is incorporated into these Terms by reference.

Intellectual property

The App, including its design, branding, presets, and software, is owned by Momently or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the App to you.

Disclaimer of warranties

The App is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that countdowns, widgets, or Live Activities will always refresh at a particular precision.

Limitation of liability

To the maximum extent permitted by law, Momently and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us for Momently Pro in the 12 months before the claim or (b) USD $10, except where liability cannot be limited under applicable law.

Apple as third-party beneficiary

You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. Apple is not responsible for providing maintenance or support for Momently, and Apple has no warranty obligation for the App except as required by applicable law regarding refunds through the App Store.

Termination

These Terms remain in effect until terminated. You may stop using the App at any time by deleting it. We may suspend or terminate access to Pro features or the App if you violate these Terms. Sections that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive termination.

Changes

We may update these Terms as the product evolves. The “Last updated” date will change when we do. Continued use of the App after an update means you accept the revised Terms. If you do not agree, stop using the App.
